1Who we are and what this is
In shortYou are reading the contract. It applies as soon as you create an account.
These terms are between you and the operator of smsmeteor.com ("we"). They govern your use of smsmeteor.com, the panel, the API and every message you send through them. By creating an account or making a request to the API you accept them. If you use the service for a company, you confirm you may bind that company.
2The service
In shortWe carry SMS to carriers for a published per-message price. We do not guarantee delivery; carriers do not either.
We provide a platform to compose, schedule and send SMS messages to mobile numbers in the destinations listed on the coverage page, through the panel or the API, and to receive delivery information about them. We route messages to carriers; delivery to the handset is performed by carriers we do not control. We do not guarantee that any message will be delivered, delivered within a given time, or displayed with a given sender identifier.
3Account
In shortOne email address, a strong password, your responsibility for what the account does.
An account requires a working email address. You are responsible for keeping credentials and API keys confidential and for all activity under the account, including by team members you invite. We may require two-factor authentication. You must be at least 18 and legally able to contract.
4Prices and payment
In shortPrepaid balance, funded in the listed cryptocurrencies, debited per segment when a carrier accepts the message.
Prices are per SMS segment and per destination as shown on the pricing page at the time a message or campaign is created; a campaign keeps its rate until it completes. You fund a prepaid balance in the cryptocurrencies we list; credit is applied after network confirmation at the market rate we display at that moment. The balance is debited when a carrier accepts a message. Messages we reject before sending are never charged. Failed and expired messages were attempted and are charged. Balances do not expire. Refunds are governed by the refund policy.
5Acceptable use
In shortThe acceptable use policy is part of these terms. Breaking it can end the account.
You agree to the acceptable use policy, which is part of these terms. You are solely responsible for the content of your messages, for holding the consents the law requires for the recipients you address, and for complying with the laws of the destination. We may suspend routes, hold traffic for review, or terminate the account for violations, and may withhold refund of balance used to pay for prohibited traffic to the extent the law allows.
6Sender identifiers
In shortYou may use names you are entitled to use. Carriers may replace or refuse them.
You may only use sender identifiers you are entitled to use. Carriers may replace, register, or refuse identifiers according to their rules; we display the expected behaviour per destination but do not guarantee it. Impersonating a third party through a sender identifier is a violation of the acceptable use policy.
7API
In shortKeys are yours to protect. Limits and versions are documented; we keep old versions for a year.
API keys are confidential and may be revoked by you at any time. Rate limits are documented and may be enforced technically. We may introduce new API versions; a version remains available for at least twelve months after its successor is released. Additive changes may be made at any time.
8Availability
In shortWe aim for the uptime shown on the status page. We do not promise it as a contractual figure.
We operate the service with the goal of continuous availability and publish incidents and maintenance on the status page. The service is provided as is; figures on the status page are informational and not a service level commitment unless a separate agreement says so.
9Data
In shortMessage content and delivery data are kept for 90 days. The privacy policy has the rest.
We process the data described in the privacy policy, including message content and delivery information, for 90 days unless you request earlier deletion or the law requires otherwise. You warrant that you may lawfully provide us the numbers and content you send.
10Liability
In shortOur liability is capped at what you paid us in the previous three months. No indirect damages.
To the extent permitted by law, our total liability arising from the service is limited to the amounts you paid us in the three months preceding the event. We are not liable for indirect or consequential loss, lost profit, or loss caused by carriers, networks or your own systems. Nothing here limits liability that cannot be limited by law.
11Termination
In shortYou can leave any time. So can we, with notice, or immediately for violations.
You may close the account at any time after requesting the refund of any balance. We may terminate with 30 days notice, or immediately for a violation of these terms or the acceptable use policy. Clauses that by nature survive, including liability and data, survive termination.
12Changes
In shortWe may update these terms; material changes are announced 30 days ahead.
We may amend these terms. Material changes are announced on the blog and by email to the account address at least 30 days before they take effect. Continued use after that date is acceptance.
13Law and disputes
In shortGoverned by the law of the operator's country of establishment. Write to us first.
These terms are governed by the law of the operator's country of establishment. Before any formal step, write to [email protected]; most disputes are resolved there. Where a competent court is required, it is the court of the operator's place of establishment, without prejudice to mandatory consumer protections.
